This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 12.11.2022 in connection with Kandhamal District Mobile Excise P.R.No. 81 of 2022 corresponding to 2(a) C.C. Case No. 28 of 2022 pending in the Court of learned Sessions Judge-cum-Special Judge, Phulbani for the alleged commission of the offence under Section-20(b)(ii)(B) of the N.D.P.S. Act.

Having regard to the fact that the seized contraband is less than the commercial quantity being 15 Kgs. 500 grams of contraband ganja, I am inclined to allow the petition for bail of the petitioner. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the I.I.C. of Khamar Police Station, Angul on every Sunday at 10.00 A.M. for a period of six months and such fact shall be certified by the I.I.C. to the concerned Court once in a month.

Accordingly, the BLAPL is disposed of.
