Ashok Kumar Das v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
WPC (OAC) No.465 OF 2019 Ashok Kumar Das .....
Petitioner Mr. A. Sahoo, Advocate Vs.
State of Odisha & Ors.
.....
Opposite parties State Counsel
CORAM:
DR. JUSTICE B.R. SARANGI
ORDER
30.09.2022 Order No.
This matter is taken up by hybrid mode.
2.
Heard learned counsel for the parties.
3.
The petitioner has filed this writ petition seeking direction to the opposite parties to regularize his service w.e.f. 28.02.2014 and grant all consequential relief on the basis of such regularization.
4.
As it appears, the Chief Engineer, Rural Water Supply and Sanitation, Odisha has issued letter dated 18.03.2014 to all Superintending Engineers, RWS&S, Circles/all Executive Engineers, RWS&S Divisions with regard to sending the names of Work Charged employees, who have completed five years uninterrupted service in Work-Charged Establishment as on 28.02.2014, for consideration of their case for regularization by bringing over them to Regular (wages) Establishment. It is contended that the same has not been implemented so far as the petitioner is concerned, though the initial date of his joining as NMR is 06.05.1988.
5.
In that view of the matter, this Court disposes of the
writ petition directing the opposite parties to act upon the letter dated 18.03.2014 at Annexure-3 issued by the Chief Engineer, Rural Water Supply and Sanitation, Odisha and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
Issue urgent certified copy as per rules.
