This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

The petitioners are in custody since 23.10.2022 in connection with Mohana P.S. Case No. 187 of 2022 corresponding to G.R. Case No. 246 of 2022 pending in the Court of learned J.M.F.C., Mohana for the alleged commission of the offence under Sections-379/34 of the I.P.C. r/w. Section.55-E of the Orissa Forest Act. 4.
It is alleged that the petitioners were transporting raw sandal wood pieces in a car when they were apprehended by the staff of Mohana Police Station. 199Kgs. of sandal wood pieces and cash of Rs.5,360/- were recovered from them.

Having regard to the fact that the investigation appears to have progressed substantially and taking into account the period of detention of the petitioners in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose.

Accordingly, the BLAPL is disposed of.
