The Petitioner in this RPFAM seeks to assail the order dated 28th September, 2021 (Annexure-2) passed in I.A. No.149 of 2019 (arising out of Cr.P No.165 of 2019), whereby learned Judge, Family Court, Kendrapara directed the Petitioner to pay an interim maintenance of Rs.5,000/- to the Opposite Party-Wife from the date of application i.e. 23rd October, 2019 along with litigation expenses.

In course of hearing, Mr. Das, learned counsel for the Petitioner prays for withdrawal of the RPFAM seeking liberty to file properly constituted CRLMP assailing the impugned order under Annexure-2.

Granting such liberty, this RPFAM is disposed of as withdrawn.

Urgent certified copy of this order be granted on proper application.
