This Interlocutory Application has been filed by the Petitioner for modification/correction of order dated 07.12.2022 passed in W.P.(C ) No.31417 of 2022.

Considering the averments made in the application itself and after hearing learned counsel for the Petitioner, the order dated 07.12.2022 passed in W.P.(C ) No.31417 of 2022 is recalled and fresh order is passed in W.P.(C ) No.31417 of 2022. 4.

The present Writ Petition has been filed with the following prayer:- " (A) Why the Opp.Party No.1 will not invite fresh tender for Petrol Pump by open advertisement and/or in the alternative the Opp.Party No.8 shall not be directed to dispose of the Petitioner's representation under Annexure-5 within a stipulated period by affording an opportunity of hearing to the Petitioner". 4.

In course of hearing, learned counsel for the Petitioner states that highlighting his grievances, the Petitioner has made a representation to Opposite Party No.8 vide Annexure-5 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.8 to consider the representation filed by the petitioner vide Annexure-5, and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy of this order.

Issue urgent certified copy as per Rules.
