W.P (C) No. 31495 of 2022 Dr. Rashmi Manjula Sahoo .....

Petitioner Dr. L. Sahu, Advocate Vs.

State of Odisha and another .....

Opposite Parties Mr. H.M. Dhal, AGA

CORAM:

DR. JUSTICE B.R. SARANGI MR. JUSTICE BIRAJA PRASANNA SATAPATHY

ORDER

24.11.2022 Order No.

03.

This matter is taken up through hybrid mode.

2.

Heard Dr. L. Lahu, learned counsel for the petitioner and Mr. H.M. Dhal, learned Additional Government Advocate for the State. 3.

The petitioner has filed this writ petition seeking direction for early release of the awarded amount in L.A. Case No. 58 of 2011 pending before the Civil Judge (Sr. Division), Kujang in her favour. 4.

Learned counsel for the petitioner is unable to answer the query made by this Court and also unable to say what is the present position of the L.A. Case No. 58 of 2011. All the time, he only states that that hearing is pending and also states about the order passed by this Court in the earlier writ petition, i.e. W.P.(C) No. 30068 of 2011, which has been placed on record under Annexure-1.

5.

On perusal of the order dated 02.04.2012 passed in W.P.(C) No. 30068 of 2011, it is seen that this Court in the said order recorded that the

prayer sought for in that writ petition by the petitioner cannot be granted and it was open for the petitioner to appear before the civil court and seek for such relief.

6.

In view of the above position, this Court is not inclined to entertain the prayer made in this writ petition.

7.

The writ petition is accordingly dismissed.
