I.A. No.187 of 2023

1. Heard learned Counsels for the parties.

2. This I.A. has been filed for modification of order dated 13.12.2022 in ABLAPL No.15091 of 2022.

3. Learned counsel for the Petitioner submits that the alleged FIR was registered under Section 341/323/324/427/294/506/34 of IPC but subsequently after charge-sheet, it turned to the offence under Section 341/323/427/294/506/307/147/148/149 of IPC.

4. Considering the grounds taken by learned counsel for the Petitioner, two weeks further time from today is extended as last chance to the Petitioner to surrender before the learned court below, vide order dated 13.12.2022 passed in ABLAPL No.15091 of 2022, but subject to payment of cost of ₹500.00 (Rupees Five Hundred) to the Advocates' Welfare Fund of

// 2 // Orissa High Court Bar Association and producing the Money Receipt thereof before the concerned court.

5. Since Section 307 of IPC is made out after submission of charge-sheet, the court below shall not grant anticipatory bail, if the injuries are found to be grievous in nature and there appears criminal antecedent standing to the credit of the Petitioner.

6. It is made clear that other conditions in the said order remain unchanged.

7. The I.A. is disposed of accordingly.
