1. Heard learned counsel for the Petitioner and learned ASC for the Vigilance Department.
2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s.409/420/467/471/120-B IPC read with Section 13(2)/13(1)(a)/12 of the PC Act.
3. Learned counsel for the State Vigilance referring to the report submits that the present Petitioner being the Motivator of Chhaitana Grama Panchayat certified the completion of construction of the latrines that finally released the bills in favour of the beneficiaries thereby implicate himself directly in respect to the misappropriation of the funds.

4. In such view of the matter, keeping in view the nature of allegations, the circumstances appearing, the seriousness and gravity of the offences, this Court is not inclined to grant anticipatory bail. The ABLAPL is accordingly dismissed. (Chittaranjan Dash) Judge KC Bisoi
