This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.246 of 2022 arising out of Mohana P.S. Case No.187 of 2022 pending in the Court of learned J.M.F.C., Mohana for offences punishable under section 379/34 of the Indian Penal Code read with section 55-E of the Odisha Forest Act, 1972.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 24.10.2022 and the offences are triable by Magistrate and two of the co-accused persons, namely, Jamal Khan and Sujauddin Khan have already been
// 2 // released on bail by this Court in BLAPL No. 11550 of 2022 and the petitioner's implication in the case is based on confessional statement of aforesaid co-accused persons before police and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper. The BLAPL is accordingly disposed of.
