This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction to learned Judge, Family Court, Bhubaneswar to dispose of C.P. No.706 of 2021 filed under Section 13-B of the Hindu Marriage, Act, 1955 (for short 'the Act').

It is submitted by Mr. Mohapatra, learned counsel for the Petitioner that although cooling off period of six months from the date of first move of the petition has since been over, learned Judge, Family Court is not taking up the petition for early disposal of the civil proceeding. Having not followed the procedure as aforesaid, the Petitioner is constrained to move this writ petition praying for early disposal of the civil proceeding. 4.

In view of such submission, this writ petition is disposed of with an observation that the parties to the civil proceeding, if so advised, may move learned Judge, Family Court, Bhubaneswar for early disposal of C.P. No.706 of 2021 filed under Section 13B of the Act. Urgent certified copy of this order be granted on proper application.
