Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to sanction the pension and retiral benefits, i.e. Gratuity, Unutilized Leave salary and Commuted Value of Pension in favour of the petitioner by regularizing the suspension period from 17.10.2007 to 04.10.2009 and release the salary for the said period as per the final order dated 05.10.2009 and report dated 24.12.2014 as well as the proposal for allotment of fund dated 03.08.2017 vide Annexures-2, 6 and 9.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made representation to the opposite party no.2 vide Annexure-11 and direction may be given to consider and dispose of the same, taking into account Annexures-6 & 9 within a stipulated time, to which learned Standing Counsel for S&ME Deptt has no objection. 5.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.2 to take a decision on the representation filed by the petitioner vide Annexure-11, taking into account Annexures-6 & 9 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner. 6.

Issue urgent certified copy as per rules.
