1. 1. This matter is taken up through hybrid mode.
2. The writ petition has been registered before this Court on 31.01.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Bhubaneswar.
3. None appears for the petitioner when the matter is called.
4. On perusal of the available order sheets of the learned Tribunal it is indicated that the matter was not admitted by the learned Tribunal nor notices were issued. On 18.05.2019 as well as 15.07.2019, learned Tribunal directed learned State Counsel as well as learned counsel appearing for O.P. No.4OSSC (Odisha Staff Selection Commission) to obtain instruction.
5. The instructions provided by the O.P. No.4-OSSC by letter dated 28.06.2019 filed before the learned Tribunal is on record. At page-2 in the last paragraph of the said instruction the following has been stated :
"The D.G. & I.G. of Police, Odisha, Cuttack has not yet submitted any non-joining vacancy position inidicating the name of candidates and their category for publication of supplementary select list. The D.G., Fire Services, Home Guards & C.D. has only given the non-joining vacancy position for 3
posts. (one in the UR category and two in the ST category)."
6. Having heard learned AGA as well as learned counsel for O.P. No.4, the writ petition is disposed of granting liberty to the petitioner to revive the same within ninety days for any surviving cause of action.
