Heard learned senior counsel for the Parties. 2.
The Writ Petition involves the following prayer :- "Under the aforesaid facts and circumstance, the Petitioner humbly prays that this Hon'ble Court may graciously be pleased to , 1.Direct order that the Sarpanch/O.P. No.4 shall discharge official function of the Gram Panchayat only in the Gram Panchayat Office as handed over by the BDO to the Sarpanch in the letter dt.11.10.2021 under Annexure-4. 2.Direct order that the opposite parties Nos.2 & 3, the Collector and the BDO shall ensure regular function of the Gram Panchayat Office in the newly constructed Gram Panchayat Office Building over plot No. Khata No. as handed over by the BDO to the Sarpanch under Annexure-4. 3.Pass such other orders as may be deemed fit and proper in the interest of justice."

From the representations at Pages-22 & 23 of Annexure-6, there appears, there is serious complaint against the Sarapanch involved to the Collector, Nabarangpur alleging when there is a notified Office of the Sarapanch, the Sarapanch is not having his
// 2 // sittings there and he is holding Office in his residence, which is not a declared Office. Considering the serious allegations, when there is a notified place for the sitting of the Sarapanch, there should not be any other sitting place by the Sarapanch. However since a representation is pending before the Collector, Nabarangpur, O.P.2, O.P.2 is directed to look into such serious allegation and do the needful by completing the entire exercise at least within a period of one month from the date of communication of this order by the Petitioner. In the decision making process, O.P.2 may also involve the complaints involved a large number of Members of the Panchayat.
