1. 1. This matter is taken up through hybrid mode.
2. The writ petition has been registered before this Court on 31.01.2022 after the Original Application was transferred from the learned Orissa Administrative Tribunal, Principal Bench, Bhubaneswar upon its abolition.
3. On perusal of the available order-sheets of the learned Tribunal, it is indicated that the matter was admitted and notices were issued on 10.04.2019 directing to file counter within four weeks and rejoinder was to be filed within two weeks thereafter.
4. In the interim, it was directed as follows: "so far as prayer for interim order is concerned, pendency of the O.A. is no bar for revocation of his suspension order under Rule 12(5) of the O.C.S.(C.C. & A) Rules,1962.
5. None appears for the petitioner when the matter is called.
6. The petitioner was aged about 58 years when he approached the learned Tribunal in the year 2019 then
// 2 // working as Deputy Superintendent of Police, DIB under suspension in the office of the Superintendent of Police, Nayagarh.
7. Learned Additional Government Advocate referring to the averments made in the writ petition submits that by efflux of time, noting would survive for adjudication, more so, as the petitioner would have retired on attaining the age of superannuation in the year 2021.
8. Having heard the learned Additional Government Advocate, the writ petition is disposed of granting liberty to the petitioner to revive the petition within ninety days for any surviving cause of action.
