01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "Under the above facts and circumstances, it is humbly prayed that this Hon'ble Tribunal may be graciously pleased to allow this Original Application by granting following reliefs:

(A) Necessary order/orders be passed directing Opp. Parties to grant the benefits of Govt. Policy decision taken and communicated vide letter No.39363 dtd.28.12.98 of the Commissioner-cum-Secretary of S&M.E. Dept., by regularly absorbing applicant as regular Level V Teacher w.e.f.1.4.2001 in the cadre instead of Ex-cadre with all consequential service benefits at par with others.

(B) Or in alternative, any other order / orders / direction / directions be issued so as to grant the complete relief of Level-V teacher to the applicant at par wither others with full service and notional financial benefits, as deemed fit and proper in the given facts and circumstances of the case."

4. Learned counsel for the Petitioner further submits that through highlighting his grievances, the Petitioner has filed an application at Annexure-11 to the Writ Petition before the O.P. No.2, but till date nothing has been done in the matter. In such background, learned counsel for the Petitioner prays that a direction be issued to Opposite Party No.2 to take a decision on the above noted Petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.2 to take a decision on the above noted petition taking into account Annexure-3 within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.
