For pendency of the Application of the Petitioner before the Commissioner, Cuttack Municipal Corporation, vide Annexure-3 series regarding encroachment of a road and clearing thereof, this Court finds, the Writ Petition is not entertainable at this stage, as there should be a decision by the Competent Authority. It is in this view of the matter, the Commissioner, Cuttack Municipal Corporation, O.P.2 is directed to consider the complain, vide
// 2 // Annexure-3 series and do the needful by completing the entire exercise within a period of four months but however involving the Parties likely to be affected. A copy of this order along with copy of the Writ Petition be served on the Commissioner, Cuttack Municipal Corporation for her doing the needful.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
