Mr. Das, learned advocate appears on behalf of petitioner and submits, his client was selected as a beneficiary of the housing scheme. First installment of the benefit was paid to him. His client continued and completed construction of the house. The authority instead of paying rest installments, issued notice dated 23rd June, 2022 for recovery. He submits, this notice was issued at instance of persons opposed to his client receiving the benefit. His client made representation acknowledged by opposite party no.2 on 26th September, 2022.

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, recovery proceeding was initiated by the Collector (opposite party no.2).

Opposite party no.2 will consider petitioner's representation as causes shown to the notice for recovery. Within four weeks of communication said opposite party will inform result of the consideration and whether he will get the balance benefit or the recovery proceeding is to be continued.
