01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.
3. The Petitioner has filed the present Writ Petition with the following prayer:- "i. In view of the facts stated above, Hon'ble OAT may graciously be pleased to allow the O.A and may further be pleased to direct respondents to grant 3rd financial up gradation to the applicant with effect from 01.01.2013 in PB- 3 i.e. Rs. 15,600-39,100 with GP of Rs 60/modifying previous sanction order at Annexures2, and ii. Hon'ble OAT may further be pleased to hold that non extension of financial benefits under 3 financial up gradation to the applicant keeping Annexure-3 & 4 is discriminatory and bad in eye of law, and iii. Hon'ble OAT may further be pleased to direct respondents to refix the pay of the applicant and to disburse the arrear within a period of 3 months to the applicant as the applicant is going to retire from Government service on superannuation w.e.f.31.12.2020, and iv. Hon'ble OAT may further be pleased to pass any other order/orders as deem fit and proper."

4. Learned counsel for the Petitioner further submits that through highlighting her grievances, the Petitioner has filed an application at Annexure-5 to the Writ Petition before the O.P. No.3, but till date nothing has been done in the matter. In such background, learned counsel for the Petitioner prays that a direction be issued to Opposite Party No.3 to take a decision on the above noted Petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.3 to take a decision on the above noted petition taking into account Annexure-6 within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.
