It is submitted by Mr. B.B. Mohanty, learned counsel that though he had appeared for the petitioner earlier, the petitioner has taken back the file after obtaining his consent to engage any other counsel.

When the matter was last taken up on 11.10.2022, the following order was passed:- "1. This matter is taken up through hybrid mode.

The writ petition has been registered before this Court on 1st February, 2022, after the Original Application was transferred from the learned Odisha Administrative Tribunal, Principal Bench, Bhubaneswar upon its abolition.

On perusal of the available order sheets of the learned Tribunal, it is indicated that though the matter was listed as many as eight occasions starting with 21.08.2018 till 11.02.2019, it could not be taken up for admission, thereafter by order dated 29.03.2019 transferred the O.A. from Cuttack to Bhubaneswar was allowed.

Learned counsel for the petitioner submits that he may be accommodated for some time since the matter being old one so as to enable him to obtain instruction from the petitioner.

Learned Addl. Govt. Advocate submits that

// 2 // since the matter has never been admitted for the last 4 years, nothing would survive at present for adjudication.

Having heard learned counsel for the parties, to grant another opportunity to the petitioner, list on 22nd November, 2022."

In view of the above, the writ petition is disposed of granting liberty to the petitioner to revive the same within ninety days for any surviving cause of action. (M.S. Sahoo) Judge
