This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with G.R. Case No.433 of 2021 arising out of Parjang P.S. Case No. 442 of 2021 pending in the Court of learned J.M.F.C., Parjang for alleged commission of offences under sections 341/452/323/ 325/397/506/34 of the Indian Penal Code.
Learned counsel for the State submitted that it is a case and counter case and the so called injured has
// 2 // absconded and therefore no steps have been taken for sending him for medical examination on police requisition.
Considering the submissions of learned counsel for the respective parties, the nature of accusation against the petitioner and that there are no such material to attract the ingredients of the offence under section 307 of the Indian Penal Code, the interim order dated 04.01.2022 is made absolute.
Accordingly, the ABLAPL stands disposed of.
