This matter is taken up through hybrid mode.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to sanction and disburse the arrear financial benefits in terms of the office order dated 06.05.2022 of the BEO, Pattamundai and re-authorize the pension of the petitioner accordingly as per the letter of the Pension Sanctioning Authority under Annexure-4 series as has been granted in favour of one Niranjan Nayak under Annexure-3 series.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made a representation to the opposite party no.5 vide Annexure-5 and direction may be given to consider and dispose of the same, taking into account Annexure-3 and 4 within a stipulated time, to which learned Standing Counsel for School & Mass Education Department has no objection.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.5 to take a decision on the representation filed by the petitioners vide Annexure-5, taking into account Annexures-3 & 4 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioners. 6.

Issue urgent certified copy as per rules.
