This the second journey of these Petitioner in filing this application under Section-438 of the Cr.P.C. who have been implicated in connection with Jaleswar P.S. Case No.30 of 2018 corresponding to C.T. Case No.60 of 2018 pending on the file of learned J.M.F.C., Jaleswar for alleged commission of offence under section 363/366/376(2)(i)/506/34 of the IPC read with section-4 of the POCSO Act, for his grant of anticipatory bail in the event of his arrest in the above mentioned case. 3.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed as also the earlier order dated 03.011.2021 in ABLAPL No.16845 of 2019; while being not inclined reconsider the prayer for grant of anticipatory bail to the Petitioner, this application is disposed of with the observation that when the

// 2 // occasion would so arise before the learned Court in seisin of the case to consider the prayer for grant of regular bail to the Petitioner, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective and disposed of early in accordance with law, so as to enable the Petitioner to move the next higher forum early in case necessity so arises. 5.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
