This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with C.T. Case No.290 of 2019 arising out of Komna P.S. Case No.290 of 2019 pending in the Court of learned J.M.F.C., Komna for offences punishable under section 420 of the Indian Penal Code.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 10.09.2022 and charge sheet has been submitted under section 420 of the Indian Penal Code and the offence is triable by Magistrate and taking into account the nature of accusation against the petitioner and on hearing the learned counsel for the State, I am
// 2 // inclined to release the petitioner on bail.
Let the petitioners be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) each with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.
The BLAPL is accordingly disposed of.
