This matter is taken up through hybrid mode.

This CMAPL has been filed with a prayer to recall the order dated 22nd November, 2022 dismissing the CMAPL No.557 of 2022.

On perusal of the case records attached to this CMAPL, it appears that three consecutive CMAPLs, i.e. CMAPL Nos. 557, 390 and 20 of 2022 have been dismissed for non-prosecution. This is the fourth attempt of the Petitioner to restore CMAPL No. 557 of 2022. The connected CMP No.545 of 2021 was also dismissed for non-prosecution, which was filed against an order rejecting an application under Order XXXIX Rule 3 C.P.C.

In that view of the matter, no fruitful purpose will be served by taking up the instant CMAPL on merit. Accordingly, the CMAPL is dismissed.

The Petitioner may take step for early disposal of the interim application filed under Order XXXIX Rules 1 and 2 C.P.C. on merit, if the same is still pending before learned trial Court. (K.R. Mohapatra) bks Judge
