Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 06.11.2021 in connection with Talcher P.S. Case No.472 of 2021 corresponding to G.R. Case No.2071 of 2021 pending in the Court of learned S.D.J.M., Talcher for the alleged commission of offence under Sections 376(2)(n)/313/417/323/506 of IPC. 4.

Considering the submissions, materials on record, the period of detention and in particular the statement of the victim recorded under Section 164 Cr.P.C., I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that out of two sureties for such amount as may be determined by the Court below one must belong to the district of Angul and further he shall not leave the territorial jurisdiction of the Court without obtaining leave of the said Court.
