This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner has filed the present Writ Petition with the following prayer:- " to direct the respondents to count the past service in Berhampur R.M.C.S and Berhampur Cooperative Urban Bank Ltd., Berhampur from the year 20.4.1970 to 29.10.1997 as qualifying service towards pension and pensionary benefits in his light of the order passed by the Hon'ble Tribunal in O.A. No.2045(C ) /2010 and refix his pension and pensionary benefits.

To grant an order relief as deems fit uner the facts and circumstances of his case along with cost of the application and interest @10% per annum from the date of entitlement till payment in the interest of justice."

Taking into account the submissions made, the Petitioner is permitted to make fresh representation before Opp. party No.2 in that regard within a period of two weeks from today.

It is observed that if such representation is filed by the Petitioner ventilating his grievances, the same

// 2 // shall be considered by Opp. party No.2 in accordance with law within a period of three months from the date of receipt of such representation.

With the aforesaid observation and direction, the Writ Petition is disposed of.
