The petitioner was arrested on 15.11.2021 by the Bolagarh Police Station in the district of Khurda on the strength of a warrant issued by learned S.D.J.M., Athmallik in G.R. Case No.314 of 2014 pending in his Court. The petitioner's application for bail being rejected by learned Executive Magistrate, Khurda in Misc. Case No. 575 of 2021, he moved for bail in the Court of learned 1st Additional Sessions Judge, Khurda. Such application was also rejected vide order dated 23.11.2021, whereupon, he has approached this Court seeking bail. It is submitted that in the meantime, the co-accused persons, who are similarly situated as the present petitioner have been released on bail in the original case. 3.

Learned Additional Standing Counsel does not dispute the factual submission as above.

Having regard to the submissions made, this Court is inclined to grant two weeks time to the petitioner to surrender before the learned S.D.J.M., Athmallik and move for bail and in such event, learned S.D.J.M, Athmallik shall release him on bail on such terms and conditions as it may deem fit and proper in the facts and circumstances of the case.

4. The BLAPL is accordingly disposed of.

5. Urgent certified copy of this order be granted on proper application.
