This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with 2(a)CC Case No.27 of 2021 (arising out of PR No.102 of 2020-21, submitted by OIC, Excise Station, Athagarh) pending in the Court of learned S.D.J.M., Athagarh for alleged commission of offence under section 52(a)(i) of Odisha Excise Act. Learned counsel for the State has produced the written instruction received from the Officer-in-
// 2 // charge of Athagarh Excise Station, Athagarh, in which it is mentioned that the petitioner is having two criminal antecedents. Written instruction is taken on record.
In view of the available materials on record particularly the criminal antecedents against the petitioner, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of by the Courts below as expeditiously as possible in accordance with law. The case diary be made available before the Courts concerned for disposal of the case. The ABLAPL stands disposed of.
