ORDER
07.07.2022 06.
1.
This matter is taken up through Hybrid mode.
Order No.
2.
The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 04.10.2021 passed by the learned J.M.F.C., Bhubaneswar in I.C.C. Case No.1902 of 2016 rejecting his petition to exhibit certain documents. 3.
Heard the learned counsel for the petitioner. 4.
Considering the facts and circumstances of the case, especially the fact that the trial Court by a reasoned order having rejected the petition filed by the petitioner and there appears to be no illegality in the said order as no foundation was laid for the same and the Court has also held that the same
// 2 // was not required to be called for proof of the fact as the same was not supposed to have such a clause of salary of the Director, which appears to have force, this Court is not inclined to interfere with the impugned order.
5.
Hence, this CRLMC filed challenging the impugned order being devoid of merit stands dismissed. Interim order dated 13.12.2021 passed in I.A. No.2055 of 2021 stands vacated.
6.
However, this Court observes that since it is a case under the Negotiable Instruments Act and pending near about six years, the trial Court is directed to proceed with the matter and dispose of the same as expeditiously as possible preferably within a period of one month of receipt of the certified copy of this order.
7.
A copy of this order be communicated to the Court below forthwith.
