Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners are accused in T.R. Case No.98 of 2022, pending in the file of learned Additional Sessions Judge-cum-Spl. Judge, Gunupur at Rayagada, arising out of Muniguda P.S. Case No.192 of 2022, for commission of alleged offences under Sections 20(b)(ii)(C) & 29.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Gunupur by order dated 11.11.2022 in the aforementioned case, the present BLAPL has been filed. 4.
Since the petitioner has moved this Court during the currency of investigation, this Court is not inclined to entertain this application at this stage.

Accordingly, the BLAPL along with I.A. stands disposed of.

It shall be open to the petitioner to move the learned Court in seisin for interim bail, if so advised, which shall be taken into account on its own merit without being influenced by the earlier rejection or the order passed by this Court.
