1. 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 02.02.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Bhubaneswar.

3. None appears for the petitioner when the matter is called.

4. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were never issued by the learned Tribunal apart from the order dated 25.07.2019, wherein learned Tribunal directed the learned Standing Counsel for the State to obtain instruction.

5. Learned AGA referring to the averments made in the writ petition, submits that since notices were not issued, considering the nature of grievance, i.e., acceptance of joining report of the petitioner then working as Forest Guard in the establishment of O.P.No.2-Divisional Forest Officer, Nayagarh, cause of

action would not survive after seven years of filing of the petition.

6. Having heard the learned AGA, the writ petition is disposed of granting liberty to the petitioner to revive the same within ninety days for any surviving cause of action.
