This matter is taken up through Hybrid mode.

This petition has been filed by the Petitioner to transfer C.P No.516 of 2021 instituted at the instance of the Opposite Party-husband from the court of learned Judge, Family Court, Cuttack to the court of Judge, Family Court, Jajpur. 3.

Heard learned counsel for the Petitioner. No one appears on behalf of the Opposite Party in spite of sufficiency of notice to him.

It is stated by the learned counsel for the Petitioner that Civil Proceeding No.203 of 2021 filed by the present Petitioner is pending before the learned Judge, Family Court, Jajpur and the other case i.e. Civil Proceeding No.516 of 2021 for restitution of conjugal right has been filed by the Opposite Party-husband before the Judge, Family Court, Cuttack.

// 2 // Therefore, the Petitioner seeks transfer of the aforesaid C.P. case to the court of Judge, Family Court, Jajpur. 5.

Considering the facts and the submissions made, this Court directs that C.P. No.516 of 2021 pending on the file of learned Judge, Family Court, Cuttack be transferred to the court of Judge, Family Court, Jajpur. Both the courts shall do the needful on production of the certified copy of this order and intimate the same to the opposite party.

With the aforesaid order, this TRP(C) stands disposed of.

Urgent certified copy of this order be granted on proper application.
