This matter is taken up through hybrid mode.

The writ petition has been filed by the petitioner who is working as a Library watchman in Surajmal Saha Junior College at Puri seeking a direction to the opposite parties for payment of Grant-in-Aid at par with the employees of the aided educational institutions under the Odisha Education (recruitment and conditions of service of teachers and members of the staff of aided educational institutions) Rules, 1974, The Odisha Education (Leave of Teachers and other members of the staffs of aided educational institutions) Rules 1977, the Odisha Aided Educational Institutions Employees Retirement Benefits Rules and the Odisha Aided Educational institutions employees general provident fund Rule 1983. It is further submitted that the petitioner is aggrieved by inaction of the authorities in not considering his case and seeks liberty to move the authorities by making a representation along with all the relevant

// 2 // records/documents for consideration of his case. Learned Standing Counsel in response submits that any representation that would be made shall be considered by the appropriate authority in accordance with law and disposed of in due time.

Having heard learned counsel for the parties, the writ petition is disposed of with the following order:- The petitioner, if so advised, shall make a representation before the appropriate authority along with all the documents sought to be relied upon by the petitioner in support of his claim.

The authority on receipt of such representation, shall do well to consider the representation of the petitioner and dispose of the same in accordance with law as expeditiously as possible, preferably within a period of four months from the date of communication of the certified copy of this order along with other documents sought to be relied upon by the petitioner.

The order that would be passed by the authority shall be communicated to the petitioner within two weeks. It is clarified that this Court has not expressed any opinion regarding merits of the case, in any manner whatsoever.

Issue urgent certified copy as per rules.
