Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with S.T. Case No.117 of 2022 arising out of Kakatpur P.S. Case No.119 of 2022 pending in the Court of learned Additional Sessions Judge, Nimapara for alleged commission of offences punishable under sections 376/506/450 of the Indian Penal Code. The petitioner moved an application for bail before the Court of learned Additional Sessions Judge, Nimapara which was rejected on 03.11.2022.

// 2 // In view of the 164 Cr.P.C. statement of the victim and the nature and gravity of the accusation, I am not inclined to release the petitioner on bail. The prayer for bail of the petitioner stands rejected.

The petitioner is at liberty to renew his prayer for bail after examination of the victim in the trial Court. Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
