This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Jakhapura P.S. Case No. 204 of 2011 corresponding to G.R. Case No.768 of 2011 pending in the Court of learned J.M.F.C., Jajpur Road for the commission of the alleged offence punishable under section 395 of the Indian Penal Code.

Perused the first information report.

Since the occurrence took place in the year 2011 and the petitioner has approached this Court for grant of anticipatory bail after ten years, while not

// 2 // inclining to grant anticipatory bail to the petitioner, he is at liberty to surrender and move for bail in the event of which the learned Courts below shall dispose of the same in accordance with law expeditiously and the claim of parity shall be taken into account at the time of adjudication of the bail application. The case records shall be made available to the Court concerned.

The ABLAPL stands disposed of.
