Heard learned counsel for the Petitioner and learned counsel for the State 2.

The Petitioner has filed this CRLMA challenging the order dated 15.11.2022 passed by the learned Assistant Sessions Judge, Sambalpur in G.R. Case No.2184 of 2022.

It is submitted by the learned counsel that the Petitioner was directed to be released on bail by order dated 09.11.2022 in BLAL No.7414 of 2022.

Learned Court in seisin while releasing the Petitioner on bail, inter alia, directed for furnishing cash security of Rs.1,00,000/- (rupees one lakh) by order dated 15.11.2022. It is stated that because of penury, the Petitioner is not able to arrange the same for which he is still in custody though learned Court in seisin was pleased to direct for release on 15.11.2022.

Considering the hardship of the Petitioner as submitted, the stipulation relating to furnishing of cash security of Rs.1,00,000/- (rupees one lakh) is set aside. Other conditions remain unaltered.

Accordingly, the CRLMA stands disposed of.
