This matter is taken up through hybrid mode.

Vakalatnama filed by Mr. Mishra, learned counsel for the Opposite Party No.2-Bank is taken on record. 3.

This writ petition has been filed to restrain the Branch Manager, Indusind Bank Ltd., Chandikhole-Opposite Party No.2 and the Regional Transport Officer, Angul-Opposite Party No.3 from disposing of the vehicle of the Petitioner bearing Registration No.OD19Q 2618 (Truck) to any 3rd party and transfer the ownership.

Considering the submission of learned counsel for the Petitioner, this Court vide order dated 29th November, 2022 directed Mr. Prakash Kumar Mishra, learned counsel for the Indusind Bank Ltd. to take instruction in the matter.

On instruction, Mr. Mishra, learned counsel for the Indusind Bank Ltd. submits that the Petitioner had voluntarily surrendered the possession of the vehicle with the Opposite Party No.2 on 4th July, 2022. Thereafter, several intimations were given to repay the loan amount, but of no avail. Hence, the Opposite Party No.2-Bank finding no other alternative sold the vehicle in a public auction.

In view of such submission, nothing remains to be adjudicated in this writ petition.

Accordingly, this writ petition being infructuous is disposed of.

Urgent certified copy of this order be granted on proper application.
