1. This matter is taken up through hybrid arrangement.

2. Heard.

3. This I.A. has been filed by the petitioner to recall the order dated 01.12.2022 and fresh adjudication of the case.

4. Learned counsel for the petitioner submits that since his Junior associate counsel could not place the matter properly, certain observations have been crept in order dated. 1.12.2022 which requires to be recalled as the said observation is against the present petitioner. It is further made clear that the Bolagarh P.S.Case No.270 dated 28.10.2022 has been registered on the F.I.R. allegation made by the opposite party No.4 against the petitioner.

5. In such view of the matter, the order dated 01.12.2022 is recalled.

6. In view of the above, it is further observed that considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the opposite party No.3/the I.I.C., Bolagarh Police Station to take a decision on the written report filed by the petitioner on 01.10.2022(Annexure-2) in accordance with law, keeping in the mind the decision of the Supreme Court in the case of Lalita Kumari v. Govt. of U.P. & Others1 within a period of four weeks from the date of production of certified copy of this order, if in the meantime, the same has not been disposed of.

7. Accordingly, this I.A is disposed of.

8. Urgent certified copy of this order be granted on proper application.
