This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "To combine the period of two years training under taken by the applicant with his qualifying service rendered and to recalculate his pension and Gratuity and other retirement benefit in view of Rule-24 of OCS Pension Rule, 1992 and Rule 13(b)(1) of Orissa Service Code and order of the Tribunal vide O.A. No.2730 of 2001 on that basis and to review the quantum of his pension and other retirement dues and pay him with arrears by a date to be fixed by the Hon'ble Tribunal. 4.

He further submits that through highlighting his grievances, the petitioner has filed a representation under Annexure-5 to the Writ Petition, but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.2 to take a decision on the above noted petition within a specific time period.

5. Considering the submissions made and without expressing any opinion on the merits of the case, this

// 2 // Court directs opposite party No.2 to take a decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

It is observed that while considering the claim of the petitioner, the benefit extended in favour of similarly situated persons like Basanta Kumar Das and Gajendra Prasad Bal be taken into consideration.
