Heard learned counsel for the Parties.

Drawing the attention to the action of the appellate court, Mr. Mohanty, learned counsel for the Petitioner alleges that Mutation Appeal No.207 of 2019 instituted in 2019 is pending for noncooperation of the Tahasildar, Birmaharajpur- Opposite Party No.3 who has been through several orders directed to submit status report of the land. Mr.Mohanty, learned counsel for the Petitioner claims for a direction to the Appellate Authority for timely disposal of the Appeal involved.

Mr.Panda, learned State Counsel however submits the prayer involved herein being an innocuous prayer, this Court disposes of the Writ Petition directing for early disposal of the Appeal. 4.

Considering the rival contentions of the Parties, this Court in disposal of the Writ Petition directs the Appellate Authority for showing finality in the Mutation Appeal No.207 of 2019 at least within a period of one and half months from the date of communication of this order by the Petitioner. Considering the

// 2 // direction to the Tahasildar for submitting a report, the Tahasildar, Birmaharajpur- Opposite Party No.3 is also directed in the event he is yet to submit the status report as per the direction of the Appellate Court and submitting status report at least within a period of two weeks of this order. Petitioner is permitted to supply copy of this order to the Tahasildar, Birmaharajpur- Opposite Party No.3 as well as Appellate Court for their proceeding accordingly within three working days.

Free copy of this order be handed over to learned State Counsel for appropriate instruction.

The Writ Petition stands disposed of.
