This matter is taken up through video conferencing mode.

The Petitioner in this writ petition seeks to assail the order dated 22nd October, 2021 (Annexure-3) passed by the Additional Tahasildar, Niali-Opposite Party in Mutation Case No.2451 of 2021.

In course of hearing, Mr. Nayak, learned counsel for the Petitioner submits that the Petitioner has a remedy under Rule 42 of the Orissa Survey & Settlement Rules, 1962 to assail the order impugned herein. Hence, he prays for withdrawal of the writ petition to avail statutory remedy.

Considering such submission, this writ petition is disposed of as withdrawn.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate in the manner prescribed vide Court's Notice No.4587
