This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Letter dated 13.0120223 under the signature of the Managing Director, Odisha Small Industries Corporation Ltd. written to the Registrar (Judicial), Orissa High Court was placed before this Court for consideration. Before considering the same on merit, this Court at the outset, likes to observe that the Managing Director must know that he is a litigant before this Court. Being a senior Officer of the State Government, he is supposed to know that he is to place the facts as well as records and law through their lawyer or through any of the Government lawyer in the Office of the Advocate General. Writing letter directly to the Registry is undesirable. 3.

Learned Additional Standing Counsel appearing on behalf of the State-Opposite Parties is directed to advise the Managing

// 2 // Director not to communicate to the Registry in such a manner. Further, if so advised, the Managing Director may file Affidavit before this Court, if he wants to bring some facts on record, which in his opinion is relevant for just and fair adjudication of the case. Further, with regard to the legal opinion attached to the letter, which is a privilege communication between lawyer and the client, this Court gives no comment on such opinion. However, it is made clear that in the event the order passed by this Court has attained finality and the same has not been challenged before the Division Bench by filing a Writ Appeal. Non-compliance of such order would attract severe consequence under the Contempt of Court's Act. Further, the Registry is directed to ignore letter dated 30.01.2023 of the Managing Director.
