This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Berhampur Sadar P.S. Case No. 111 of 2010 corresponding to G.R. Case No.832 of 2010 pending in the Court of learned S.D.J.M., Berhampur for the commission of the alleged offence punishable under section 420/34 of the Indian Penal Code.
Perused the first information report annexed to
// 2 // the anticipatory bail application.
Since it is a case of the year 2010 and the petitioner has approached this Court for grant of anticipatory bail after eleven years, while not inclining to grant anticipatory bail to the petitioner, liberty is granted to the petitioner to surrender and move for bail in the Court below, in the event of which the learned Courts below shall dispose of the same in accordance with law expeditiously and the claim of parity with that of the co-accused persons who have been released on bail shall be taken into account at the time of adjudication of the bail application. The case records shall be made available to the Court concerned.
The ABLAPL stands disposed of.
