In this application, the order dated 03.08.2000 passed in G.R. Case No. 167 of 1999(A) arising out of Kabisuryanagar P.S. Case No. 78 of 1999 pending in the file of learned J.M.F.C., Kabisuryanagar has been challenged. Vide the said order cognizance of offences under Section 326/307/34 of IPC are taken against the accused persons. It appears that the case has been split up against him on 24.03.2009 and thereafter process under Sections 82 and 83 Cr.P.C. has been issued against him.
Mr. Partha Sarathi Das, learned counsel for the petitioner submits that the petitioner does not want to press this application under Section 482 Cr.P.C. and further submits that the petitioner wants to surrender before the learned court below and move for bail. It is open to the petitioner to surrender before the learned court below and move for bail which shall be considered on its own merit. The CRLMC is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
