This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with G.R. Case No.98 of 2008 arising out of Khallikote P.S. Case No.27 of 2008 pending in the Court of learned J.M.F.C., Khallikote for alleged commission of offence under section 409 of the Indian Penal Code.

Since the case is of the year 2008 and in the meantime, more than thirteen years have already

// 2 // been passed, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event the petitioner surrenders before the Court below and moves an application for bail, the same shall be disposed of as expeditiously as possible taking into account the claim of parity in accordance with law. The case records shall be made available to the Court concerned.

The ABLAPL stands disposed of.
