CORAM:

JUSTICE M.S.SAHOO Order No.

ORDER

10.10.2022

1. 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 03.02.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack.

3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices on admission were issued on 5.7.2019 directing to file counter within four weeks and rejoinder was to be filed within two weeks thereafter.

4. After 5.7.2019 the matter was not taken up/pursued.

5. Learned counsel for the petitioner files a memorandum seeking a direction to withdraw the writ petition which is kept on record.

6. Learned AGA referring to the averments made in the writ petition submits that considering the nature of grievance, i.e., challenge to an order of punishment passed on 02.05.2019, i.e., censure, withholding of one increment without cumulative effect, submits that since the punishment is a minor one, having no consequential effect, nothing would survive at present for adjudication.

7. Having heard learned counsel for the parties, the writ petition is disposed of.
