Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioner no.1 was earlier on bail passed by order of this Court in BLAPL No. 1166 of 2017 and petitioner no.2 was on bail by order dated 08.11.2016 passed by the learned Addl. Sessions Judge, Koraput. However, because of nonappearance on the date fixed, NBW was issued against them, on the strength of which they were taken to custody again. 4.

It is submitted that because of communication gap between the petitioners and their lawyer, they could not appear on the date fixed but undertake to regularly appear on each date of posting of the case in future.

Having regard to the submissions as above, the prayer is allowed. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem

fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting without fail.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
