The writ petition has been registered before this Court on 3rd February, 2022, after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition. 3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was presented before the learned Tribunal on 02.07.2019, but never taken up for admission till it is listed today before this Court after more than three years.

None appears for the petitioner, when the matter is called.

The applicant before the learned Tribunal, then aged about 39 years was working as Sweeper in the office of the Commandant, 5th O.S.A.P. Battalion, Baripada in the district of Mayurbhanj, inter alia prays for a direction to regularize his services by giving him regular appointment in the post of Sweeper in the establishment of the opposite

It is submitted by the learned counsel for the State that considering the nature of grievance, nothing would survive at present as far as present petition is concerned after a passage of three years.

Having heard learned Addl. Govt. Advocate, the writ petition is disposed of granting liberty to the petitioner to revive the petition within ninety days for any surviving cause of action.
