When the matter was last taken up by this Court on 10.10.2022, the following order was passed:

"1.

This matter is taken up through hybrid mode.

2.

The writ petition has been registered before this Court on 3rd February, 2022, after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.

3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the application was presented before the learned Tribunal on 02.07.2019, listed on 26.07.2019 but never taken up for admission.

4.

Learned counsel for the petitioner submits that he may be granted time to obtain up-to-date instruction from the petitioner.

5.

As prayed for, list on 16th November, 2022."

2. As indicated in the said order dated 10.10.2022 that after presentation of the Original Application on 02.07.2019, the matter has never been taken up for

// 2 // admission till it was listed on 10.10.2022 before this Court and again today. Learned counsel for the petitioner had sought for accommodation to obtain up-to-date instruction as observed in the order dated 10.10.2022 and today a memorandum is filed seeking to withdraw the petition. The memo is taken on record.

Accordingly, the writ petition is dismissed.
