WPC NO.37852 OF 2021 Durllav Chandra Routray ....

Petitioner Mr.G.Muduli, Advocate -versusState of Odisha & ors.

....

Opposite Parties

CORAM:

JUSTICE BISWANATH RATH

ORDER

3.1.2022 01.

1.

On the oral prayer made, learned counsel for the Petitioner is Order No.

permitted to correct the prayer portion of the Writ Petition. 2.

The Writ Petition involves the following prayer :- "It is therefore prayed that this Hon'ble court may graciously be pleased to admit this writ Petition, issue notice to the Opp.Parties, call for records and after hearing the parties the decision of Opp.Parties vide Annexure-6 (series) may be quashed and the Opp.Parties may be directed to consider the case of the Petitioner for allotment of a plot ('E' Category) in Bidanasi Project Area, Sector-13 or in alternative for other sector in the next process of allotment of plot giving priority to the petitioner with any term and condition for depositing the initial deposit." 3.

The Writ Petition appears to be a matter challenging the order dated 22.12.2008 at Page-32 of the Brief. In the event the Petitioner claims through the order dated 22.12.2008, the Writ

// 2 // Petition should be dismissed as grossly barred by time. However, during course of argument, this Court from Annexure-6 finds, for availability of fresh application for allotment, in the event there is possibility of fresh consideration involving any fresh application available, the Secretary, C.D.A. is also directed to consider the request of the Petitioner, vide Annexure-6 independent of the development taken earlier provided such consideration scope is available.
